Call it the prosecutor's prerogative. The Los Angeles City Attorney's Office has officially charged Bobby Brown with multiple DUI counts stemming from his arrest Wednesday for drunken driving.

The 43-year-old New Jack Swinger was pulled over for driving erratically around 1 a.m. in Tarzana, Calif. Brown was driving without his court-mandated dashboard Breathalyzer, according to city attorney spokesman Frank Mateljan.

According to the first count against him, Brown was driving under the influence with a prior conviction and refused to take a chemical test when he was collared.

Bobby Brown's latest hit: Another DUI hit

The refusal allegation carries a mandatory, minimum two-day stay in the slammer, while driving with a prior conviction carries a four-day jail term.

Not only that, but the R&B star also was driving on a restricted license and ignored a court order to only drive vehicles that have alcohol-monitoring ignition interlock devices, which requires him to take a breath test before he can start the engine.

The second and third counts carry a maximum of six months each in the slammer and up to $5,000 in fines.

An attorney for the singer, who's out on $25,000 bail, was not available for comment.

Bobby Brown busted for drinking and driving

This is Brown's second DUI bust this year. He was popped back in March in the San Fernando Valley and ended up pleading no contest and receiving three years' probation, after which he completed a stint in rehab.

Bobby Brown's not the only celeb in trouble with the law

An arraignment on the new DUI charges is scheduled for Nov. 16, and if a judge finds that the New Edition crooner violated his probation, he could receive six months in the pokey and a $610 fine for that as well.

Of course, if Brown heads back to rehab, it's possible he could get a reprieve.

    Bobby Brown checks into rehab

Bobby Brown's latest command performance? Rehab. Nearly four months after he cut a deal on a DUI rap, the singer has checked into treatment for addiction issues.

"Mr. Brown takes his agreement very seriously and admitted himself three weeks after concluding his honeymoon in Mexico during a break from the New Edition tour," attorney Christopher Brown told E! News.

Check out Bobby and Alicia on their Hawaiian honeymoon

"Bobby is doing well and receiving services that comply with his agreement with the state of California."

"Bobby's children and loved ones are very proud of him," his wife, Alicia Etheredge-Brown said. "We appreciate his fan's prayers and well wishes. Bobby is mentally in a good place.

Brown is keeping the location of his treatment confidential, and said simply that the nature of his rehabilitation is "relating to alcohol use."

The singer is expected to continue with his New Edition and solo concert dates, including a planned Sept. 1 gig in Orlando.

Pete Doherty was actuallly ordered out of rehab in Thailand

As for the singer, Brown caught a lot of tabloid grief this year after the passing of ex-wife Whitney Houston, whose accidental drowning death was brought on by heart disease and cocaine use.

He denied being the one who got the pop icon hooked on drugs, telling TODAY back in May that being blamed for her death felt "terrible."

The reality show "Being Bobby Brown" allowed Brown and Houston to see "that our drug use had affected our relationship, had affected the love that we felt for each other," he said. Brown spent time in rehab back in 1998 after a DUI crash in Houston's car.

In good times and bad, Whitney Houston was a star to remember

Brown said in that interview that he had been off drugs for seven years, but the sit-down came a week after he pleaded no contest to misdemeanor DUI following a March 26 arrest. The "My Prerogative" singer had been pulled over for talking on a cell phone and then failed a field sobriety test.

Bobby Brown releases new song, 'Don't Let Me Die,' reportedly about Whitney Houston

    Joe Giblin / AP

    Bobby Brown

    By Courtney Garcia, msnbc.com contributor

Bobby Brown has released a new single, “Don’t Let Me Die,” which appears to honor his late ex-wife, Whitney Houston.

The Grammy Award-winning musician performed the R&B song in a live set on “The Tonight Show with Jay Leno” Wednesday night. It is the premiere single off his first solo album in 14 years, “The Masterpiece,” which will be released June 5.

“It’s been about a month since you’ve been gone, I guess it’s pretty clear you ain’t coming home,” the song begins. “I guess I messed up pretty bad, I didn’t know who you were; I didn’t know what we had.”

    Follow @ msnbc_ent

The record was released online May 9, and has garnered positive attention. Brown is currently on a reunion tour with his 1990s band, New Edition.

While he has not confirmed that the track was written for Houston, Brown described the album to CBS News as his best ever, a reflection of "what I've been through throughout my life … just trying to heal myself through my music."

He also commented on his recent arrest for DUI. "I'm going to do better in the near future," Brown said. "I just want to get back to what I do, which is entertainment, and this [the album] is the start to me getting back to what I want to do."

Houston was found drowned in her Beverly Hills, Calif. hotel room bathtub on Feb. 11. She was 48. She was married to Brown from 1992 to 2007 and they have a teenage daughter, Bobbi Kristina Brown.

Earlier this month, Brown told TODAY anchor Matt Lauer that his relationship with Houston was “great,” and called their marriage “14 beautiful years.”

"I can honestly say that I love that woman with -- with everything that I am," Brown said. “And I believe she loved me the same way."

Brown also addressed claims he introduced Houston to drugs, and was the ultimate cause of her downward spiral.

"I'm not the reason she's gone,” he insisted. “"I think if anyone ever knew us, if anybody ever spent time around us instead of time lookin' through the bubble, they would know how we felt about each other. They would know how happy we were together."

Do you think Bobby Brown has good intentions with the song, or is he capitalizing on the news to sell CDs? Tell us on Facebook.

Bobby Brown 'will always be worried about' Bobbi Kristina's alleged drug use

    By Ree Hines, TODAY contributor

In the first part of Bobby Brown's candid interview with TODAY's Matt Lauer, the R&B star discussed his past drug use and the role hard drugs played in the life (and ultimately the death) of his ex-wife, singer Whitney Houston -- drugs he claimed came into Houston's life long before he did. But of course, there's another person in Brown's life that's recently been the subject of drug-use allegations.

In the second part of Brown's sit-down, he addressed reports that indicate drugs are now an issue for the next generation -- his and Houston's 19-year-old daughter, Bobbi Kristina.

When asked if he was worried about his daughter having recently been seen smoking marijuana, and rumors of "other things," Brown insisted, "I will always be worried about that."

Video: Star-studded sendoff for Whitney Houston

But that doesn't mean that he currently believes that she's in any real danger. In fact, the 43-year-old insists he has a solid relationship with his daughter and that he would know if there was really a cause for concern.

"I know what she is actually doing," Brown said. "I think people are, you know, making assumptions of what my daughter is and how strong she is. People tend to want to control strong-willed people. And that's what I see. … I am her father.  She talks to me about everything."

    Follow @ TODAY_ent

And he's not just Bobbi Kristina's father. Brown has four other children, and three of them joined him on TODAY to defend him from his "bad boy" reputation, especially in regards to his decision to walk out of Houston's funeral because he was unwilling to be separated from his alleged "entourage."

"We were the entourage," daughter LaPrincia said, setting the record straight.

"They sat us and you know, I saw someone talk to my dad," Brown's son, Landon, explained. "But I didn't know what they were saying -- until he tapped me and said, 'Let's go.'"

Video: Details emerge about Houston's final days

According to Brown, he only delivered that message after security approached him three times and asked him to seat his "entourage" elsewhere.

"I decided that, you know, it'd be best if I just left," he said. "I kissed the casket, and me and my children left the building."

Since then, Brown hasn't been in touch with Houston's family, though he said he has attempted to reach out to the singer's mother, Cissy Houston, without success.

After hearing from his children, and listening to what he has to say about daughter Bobbi Kristina, what do you think of Bobby Brown the family man? Discuss on Facebook.

Bobby Brown: I still love Whitney Houston 'with everything that I am'

    By Randee Dawn, TODAY contributor

Bobby Brown and Whitney Houston may no longer have been a couple when she died in February, but as he told TODAY's Matt Lauer in an interview that aired Wednesday morning -- his first interview since her death -- he still  misses her fiercely.

"Our relationship was great," he said. "I had 14 beautiful, beautiful years with that woman." And it's not just his revisionist history, he insisted: "I can honestly say that -- I love that woman with -- with everything that I am. And I believe she loved me the same way."

Speaking out for the first time since the death of ex-wife Whitney Houston, Bobby Brown tells TODAY's Matt Lauer about his last encounter with Houston, the moment he learned she had died, and whether he feels responsible for her addiction struggles.

Still, Whitney and Bobby's relationship was, almost from the start, filled with conflict of one kind or the other. Brown says he never used hard drugs before meeting Houston, and said that she had used drugs before they were involved. "I worried about it when ... we first got together until I tried it," he said. "And when I tried it, for some reason, I have an addictive personality."

He does have some regrets, wondering to Lauer whether "I coulda done something different, you know to -- ensure that she had a longer life. But ... you have to want it, you know?"

The 2005 single-season reality show "Being Bobby Brown," which put an uncomfortable spotlight on their relationship and showed Houston's temper flaring, he says, was a "wake-up, because we were able to see what others were saying about us .... (to) see that our drug use had affected our relationship, had affected the love we felt for each other."

    Follow @ TODAY_ent

But Houston declined to appear on a second season of the show, and the pair separated in 2006; they divorced the following year. Still, said Brown -- who told Lauer he would be getting remarried "soon" -- he still has a lot of room in his heart for his late former wife.

"My fiancee knows how I felt about that woman," Brown said. "My kids know how I feel ... how I felt about Whitney. It's not a secret, you know? I was in love with her deeply."

Bobby Brown on the death of Whitney Houston: 'I'm not the reason she's gone'

    By Kurt Schlosser, NBC News

In his first interview since the death of Whitney Houston, Bobby Brown exclusively tells TODAY's Matt Lauer, "I'm not the reason she's gone."

    NBC

In a candid sit-down set to air Wednesday, Brown, who says he’s "very much clean and sober from narcotics," talks to Lauer about the last time he saw Houston, how he found out about her death, and why he gets blamed for her drug use. He talks about his relationship with their daughter, Bobbi Kristina, and addresses recent rumors and controversy surrounding her personal life. And Thursday, speaking publicly for the first time, three of Brown’s children and his fiancée tell TODAY how they feel about the media’s portrayal of Brown.

When asked about the last time he saw Houston, a week or so before she died, Brown says the iconic singer "had this glow about her that was just, you know, incredible. I'm saying to myself, you know, 'She must be ... she must be doing really well,' because she looked really well."

Brown says Houston, to whom he was married for 15 years, "looked like she was in a good place."

Video: Coroner says Houston took drugs before drowning

Lauer asks Brown how he took the news that cocaine was a likely contributor to the death of Houston, 48, who was found in a bathtub in a Beverly Hills hotel on Feb. 11.

"I was hurt. I was hurt ... because, you know, me being off of narcotics for the last seven years, I felt that she was, you know, I didn’t know she was struggling with it still. But at the same time, you know, listen, it's a hard fight.  It's a hard fight to, you know, maintain sobriety that way."

Based on his own feelings and how she appeared when he last saw her, Brown theorizes that that one day of cocaine use -- not the effects of longterm use -- was enough to kill Houston. "It had to be that one, because that's all it takes," Brown said. "One hit, you know ... it could definitely take your life away from you. And, unfortunately, that was it."

Lauer pressed the 43-year-old R&B star on the talk after Houston's death. "If I heard it once, I heard it a hundred times, and I know you heard it too," Lauer said. "Fans, people who say they were close to Whitney, say her life went downhill when she met Bobby Brown. How does it make you feel when you hear it?"

"It makes me feel terrible," Brown said. "But you know, I know differently. I think if anyone ever knew us, if anybody ever spent time around us instead of time lookin' through the bubble, they would know how we felt about each other. They would know how happy we were together."

Video: Houston's hairstylist opens up about star's death

Brown says the couple got a wakeup call from starring in the reality TV series "Being Bobby Brown." "We looked at the bubble and saw ourselves. We was able to see what other people were saying about us, you know? We was able to see that our drug use had affected our relationship, had affected the love that we felt for each other."

But when asked by Lauer about the popular perception that he is the one responsible for getting Houston hooked on drugs, Brown says, "not true."

"I didn't get high [on narcotics] before I met Whitney," Brown said. "I smoked weed, I drank the beer, but no, I wasn't the one that got Whitney on drugs at all." He says drugs were a part of the singer's life "way before" they got together.

"It's just ... it's just unexplainable how one could, you know, [say that I] got her addicted to drugs. I'm not the reason she's gone," Brown said.

    NBC

Video: Star-studded sendoff for Whitney Houston

In the second part of Lauer's interview, which will air Thursday, the TODAY host talks with three of Brown's children -- Landon, Bobby Jr., and La’Princia -- and his fiancée, Alicia Etheridge.

The children all say the public perception of their father is not the right one.

"I honestly feel like my dad's a great person," daughter La'Princia said. "He's been my best friend, like, my whole life. If I ever have a problem with anything, I know I can always go to him. Likewise, if he ever needs to talk to somebody, he knows he can always call me and I'll be there for him."

Son Landon says people confuse his father's stage persona with the real man. "I feel like my father's always had the bad boy image. So, you know, they just keep followin' that. Anything that they can take a negative from the situation, they blow it out of proportion and blame him."

    Follow @ TODAY_ent

Video: Details emerge about Houston's final days

    La'Princia says everyone makes mistakes.

"They don't see the good part of him that we see every single day. Everyone goes through their ups and downs. You can't be judged forever about one event in your life or just the bad decisions you've made, you can't always be judged just by that."

Bobby Brown avoids jail time with DUI plea deal

    By Us Weekly

Bobby Brown will not be going to jail. The singer's attorney pleaded no contest on Brown's behalf Wednesday to a misdemeanor DUI charge from his arrest last month.

Photos from Us: Whitney Houston, 1963-2012

According to the Los Angeles Times, Brown, 43, was sentenced to three years' probation and a day in Los Angeles County jail, but already gets credit for time served. In addition, Brown was fined $390 and was ordered to attend a 90-day alcohol education program.

The ex-husband of the late Whitney Houston was arrested March 26 at 12:20 p.m. after he was pulled over by California Highway Patrol for talking on his cellphone. Authorities said Brown later failed a field sobriety test. Brown was taken into custody and booked at the Van Nuys County Jail.

Brown's arrest occurred just four days after Houston's autopsy results were released. The legendary singer, who was 48 at the time, died tragically on Feb. 11 of accidental drowning. She was also suffering from the effects of heart disease, which were exacerbated by ongoing cocaine use.

Brown was married to Houston for 14 years before divorcing in 2007. The two have one child together, Bobbi Kristina Brown, who is now 19. Brown met up with his daughter in the Big Apple Tuesday for some quality bonding time.

A witness told Us Weekly exclusively that the father and daughter had lunch together at Blue Fin, located in the heart of Times Square.

According to the witness, Bobbi Kristina "was on her phone and texting a crazy amount. She didn't seem too thrilled to be there, in all honesty."

Bobby Brown is on his way to restoring his bad-boy reputation.

E! News can confirm that the R&B singer has been charged from his DUI arrest on Monday afternoon.

A rep for the Los Angeles City Attorney's office tells E! News that prosecutors filed three misdemeanor charges against Brown: driving under the influence, driving with a blood alcohol level greater than 0.08 percent and driving on a suspended license.

If convicted, the maximum for all counts is one year in jail.

The erstwhile New Jack Swinger got into this latest mess after he was pulled over by California Highway Patrol who witnessed him talking on his cell phone. After approaching Brown, officers suspected he had been drinking. He was subsequently taken into custody after flunking a field sobriety test and booked at the Van Nuys jail.

Brown's attorney, Tiffany Feder, was unavailable for comment. But yesterday she issued a statement to E! News professing the entertainer's innocence and saying he was only speaking on his cell phone.

Report: Bobby Brown peddling tell-all book about life with Whitney Houston

Vince Bucci / AFP - Getty Images file

Bobby Brown and Whitney Houston in 1994.

    By Courtney Garcia

Less than two weeks after the death of his ex-wife, singer Whitney Houston, Bobby Brown is back in the spotlight. A new report is surfacing that Brown, who wrote a tell-all back in 2008 about his life with the pop star, is working to get the book published.

While interest in the couple was fading at the time he wrote the book, Brown's recent return to the spotlight after Houston’s Feb. 11 death brings a better market for the story and a chance for Brown to cash in.

    Follow @ TODAY_ent

Says one major publisher to the Huffington Post, “Now is the time for a book that details an honest look into the life of Whitney."

Brown and Houston’s tumultuous marriage began in 1992, around the time her film career took off with “The Bodyguard.” Brown’s musical headlines were soon eclipsed by his ongoing battle with drugs and alcohol, and Houston had her own substance struggles. The two divorced in 2007.

The road to print may not be so simple for Brown, however, as he reportedly signed a confidentiality agreement as part of the couple's divorce, and he has their 18-year old daughter, Bobbi Kristina, to consider. And after he abruptly left the singer’s funeral on Saturday, Houston's family is already reportedly not fond of her ex.

Huffington Post commentor Frances Krafthefer writes: “Obviously, if he is thinking of publishing a tell-all book, it could never be accurate. Whitney is gone and we would hear only one side of the story. However, that will not stop book publishers, lawyers and other folks from doing anything they can to get this published.”

And DJScratch tweets, “If Bobby Brown releases that tell-all book on Whitney, then he'll prove to her family that they were right about him.”

In other Houston news, "Stomp the Yard" actress Meagan Good may be in discussions to star in a biopic about the singer, a project that began before Houston’s passing and is being hashed over this week, according to E! Online.

And Houston's biggest film hit, "The Bodyguard," may find new life as a musical. The U.K. Guardian is reporting that a staged musical version of the 1992 film is set to open at London’s West End Theater in November.

Bobby Brown returns to stage after Houston's funeral

Bobby Brown performed with New Edition at Mohegan Sun Arena after Whitney Houston's funeral ceremony on Feb. 18 in Uncasville, Conn.

    By Access Hollywood

After briefly appearing at ex-wife Whitney Houston’s funeral service in New Jersey on Saturday, Bobby Brown flew to Connecticut to put on a performance with New Edition.

The concert, which took place at the Mohegan Sun casino’s arena, lasted over an hour, and the grieving singer paid homage to Whitney, his former spouse and mother of his 18-year-old daughter, Bobbi Kristina.

“I want to give blessings to my ex-wife Whitney Houston. I love you,” Bobby told the concert crowd on Saturday night, while pointing upward toward the sky. “I want to give blessings to my kids, my brothers and all of you. Thank you for the love.”

One of Bobby’s bandmates offered support, telling the audience, “He was upset today.”

Following the performance, which included Bobby’s classic hit, “My Prerogative,” the singer – along with a group of family and friends, headed to Bobby Flay’s restaurant Bar Americain, according to People.

Bobby appeared “relaxed and low key as he posed for photos with fans,” the mag reports.

After a brief 20-minute stint at the casino’s blackjack tables, Bobby reportedly headed to a seafood restaurant with entourage and fiancée Alicia Ethridge, before heading back to their rooms around 2 a.m., according to People.

“My children and I were invited to the funeral of my ex-wife Whitney Houston. We were seated by security and then subsequently asked to move on three separate occasions.

“I fail to understand why security treated my family this way and continue to ask us and no one else to move. Security then prevented me from attempting to see my daughter Bobbi-Kristina,” the statement released to Access continued. “In light of the events, I gave a kiss to the casket of my ex-wife and departed as I refused to create a scene. My children are completely distraught over the events. This was a day to honor Whitney. I doubt Whitney would have wanted this to occur. I will continue to pay my respects to my ex-wife the best way I know how.”

'Red-eyed' Bobby Brown leaves Whitney Houston's funeral early

    By Us Weekly

Bobby Brown, right, leaves the funeral service of his ex-wife, pop singer Whitney Houston, at the New Hope Baptist Church in Newark, N.J., on Saturday, Feb. 18.

Each of the 1,500 invitations to Whitney Houston's funeral in Newark, NJ admits just one, but apparently her ex-husband Bobby Brown did not receive that memo.

According to New Jersey paper The Star Ledger, the R&B singer, 43, arrived outside of the New Hope Baptist Church Saturday afternoon with an entourage of nine people in tow, demanding that they all get seats in the front row.

The paper adds that Brown himself was allowed in, but he opted to leave with the rest of the people not admitted.

"He was allowed to go in, pay his respects and then he had to leave," a witness tells Us Weekly. "He was red-eyed going up to the casket and then left. He was there for 15 minutes."

A source has told Us that there is still underlying tension between Houston's relatives and Brown, who married Houston in 1992. Their divorce was finalized in 2007.

"There are family members who felt Bobby drove Whitney into drugs," one source explained. "But now Bobby is clean and Whitney has unfortunately passed. So there's resentment."

Brown is expected to perform at his scheduled concert, which takes place at the nearby New Jersey Performing Arts Center.
