    Kanye West sued over 'Gold Digger' sample

    Kanye West is being accused of copyright infringement.

    Did Kanye West mine another artist's work for "Gold Digger" and forget to tell anybody?

    That's what the children of late Thunder & Lightning musician David Pryor claim in a multimillion-dollar copyright infringement lawsuit filed this week against West, in which they allege that he wrongfully sampled their dad's "get down" chants from the 1974 tune "Bumpin' Bus Stop." 

    "Gold Digger," which most prominently borrowed from Ray Charles' "I Got a Woman," was a single off of West's 2005 album Late Registration--and Pryor's kids admit that the timing of their complaint seems a bit off.

    "The complaint makes clear that 'Gold Digger' was released in 2005 while David Pryor was in a convalescent hospital suffering from a host of severe mental and physical disabilities, including senile dementia, cerebrovascular disease, prostate cancer, epilepsy, and diabetes," attorney Courtney M. Coates said in a statement obtained by E! News. 

    "He died in May 2006 from cerebrovascular disease without having any knowledge that his voice was being exploited by other artists for commercial profit. After David Pryor died, [daughter Trena and son Lorenzo] discovered Pryor's song in late 2010, but they could not secure rights to the song until Pryor's estate was probated and a final determination of heirs was made in 2011. In 2012, the family obtained all of the necessary information required to file this substantial lawsuit against Kanye and others."

    Coates states that the family is aware of 50 instances of Pryor's vocals being sampled in recordings and they are "putting all record companies on notice that they will be sued if they continue to steal and exploit David Pryor's vocal performance in 'Bumpin' Bus Stop' without the family's permission." 

    The lawsuit, filed in L.A. Superior Court, asked for "millions of dollars" in damages from West, Roc-A-Fella Records, UMG's Island Def Jam and other corporate defendants, as well as an injunction preventing further unauthorized use of David Pryor's work.

    Kim Kardashian won't name baby 'North West'

    Kim Kardashian and Kanye's baby will not be named North West, the E! reality star told Jay Leno on Thursday's "Tonight Show." But they're not necessarily going in another direction with the moniker. 

    "You know what name I do like, but it probably won't be on (our list)?" she told the host. "I do like --because it kind of goes with North -- I like Easton. Easton West. I think that's cute."

    Leno, obviously trying for a big gender reveal, asked, "Isn't that a boy's name?"

    "Boys' names are good for girls," she said coyly.

    Boy or girl -- and our money's on the latter -- Kim insists her infamous "momager," Kris Jenner, "will not be handling anything for the baby."

    Dashing (ahem) any hopes for a "Keeping Up With Kimye" spinoff, Kim insisted: "The baby is not hopefully going to do anything in the business or have a show or anything like that."

    Justin Timberlake slams Kanye West on 'Saturday Night Live'

    Justin Timberlake fired back at Kanye West this weekend on "Saturday Night Live."

    During the five-time host's first musical performance, J.T. took a subtle shot at Kim Kardashian's baby daddy with a slight tweak to the lyrics of "Suit & Tie."

    "My hit's so sick got rappers acting dramatic," he crooned (at the 2:15 mark), instead of the hit single's original line, "s--- so sick got a hit and picked up a habit."

    The dramz in question refer to Kanye's latest "Clique" rant during a recent show in London (where everything seems to happen these days).

    "I got love for Hov, but I ain't f---ing with that 'Suit & Tie,'" the aggrieved rapper grumbled about his pal Jay-Z's new collaboration with J.T.

    Hov clearly has love for the prince of pop: In addition to sharing the stage in their upcoming Legends of Summer stadium tour, Beyoncé's hubby made a surprise appearance on "SNL," grabbing a mic for "Suit & Tie" -- just moments after Timberlake's Kanye dis.

    Your move, 'Ye.

    Kanye West disses Jay-Z, Justin Timberlake, corporations onstage

    Kanye West has never been one to bite his tongue, but diss Jay-Z ... that's a different story. Putting the duo's 2011-2012 "Watch the Throne" tour to the side, the loquacious rapper hit the stage during his show in London Saturday and sounded off about Jay-Z and Justin Timberlake's "Suit & Tie."

    Pregnant Kim Kardashian says Kanye West has taught me the value of privacy

    "I got love for Hov, but I ain't f------- with that 'Suit &Tie,'" Kim Kardashian's baby daddy told the crowd as an instrumental "Clique" played in the background, which features him and Jay-Z.

    And that was just the beginning of Kanye's rant about the music industry.

    "I hate business people," West rapped, according to Billboard. "People get on the phone with me and tell me, 'What kind of business can you do, though? What type of business are you doing? What's the numbers? How much did you sell? What's the radio spins? How much shampoo can you sell with your face on it and sh--. Remind me again why we in this sh---. Can you remind me again why we in this sh--? Since when (is) making music about getting rich? Since when was making art about getting rich? ... Remind me again why we in this sh--."

    Oh, yes, there was even more during the 10-minute rapped speech.

    "Can I sell a drink for you, please?" West continued. "So you can help me put on a better show. Please corporations. Can you please support me? I swear I'm a nice n---- now. And if they believe in me they should also believe in you. What's my public rating now? Are they liking me again? They forgot about the whole Beyonce thing right? Okay, cool."

    Last week, Jay-Z and Timberlake officially announced that they will embark on a tour together, performing in 12 cities this summer.

    Something tells us West won't be making an appearance.

    Bad idea: Airline employee whisks Kim and Kanye around security

    An airline employee might have thought he or she was helping out a celebrity couple on Tuesday, but the worker's actions put Kim Kardashian and Kanye West at the center of a major security misunderstanding.

    The couple had just flown from Brazil to New York's John F. Kennedy International Airport and were trying to make a connecting flight to Los Angeles.

    According to a statement from the Transportation Security Administration, "an airline employee escorted the two travelers through a non-public area in order to provide expedited access." In doing so, Kardashian and West ended up bypassing a TSA security checkpoint.

    The TSA discovered the situation before the plane took off and Kardashian and West were given a private security screening at the jetway, the statement said. But the actions delayed the flight -- and the other passengers onboard -- for nearly an hour.

    The TSA statement puts blame not on the couple, but on the over-helpful employee, and is actively investigating the incident.

    Move over, Baby New Year, and make way for Kimye Jr. Yes, indeed, Kim Kardashian is pregnant with Kanye West's baby!

    E! News has confirmed with the Kardashian family that Kim is expecting her first child with the rapper. But it was West who already spilled the exciting news to a few hundred concertgoers.

    During his Atlantic City show on Sunday night, West decided to announce that Kim was expecting to all his fans.

    And the congratulatory tweets have already begun for the future parents.

    "Congrats to Kim and Kanye. Happy for both of them... bit.ly/YE4Uzh," Russell Simmons tweeted, while the Kardashians all showed their joy for the newest member of the family. "Im a happy girl !!!!!!!!! Wowza! Oh BABY BABY BABY," Kris Jenner tweeted.

    Khloé Kardashian Odom wrote, "Keeping secrets is hard with so many family members! Especially when you are so freaking excited!!!!! LOVE is everything!!!!" Kourtney Kardashian also went to Twitter with, "Been wanting to shout from the rooftops with joy and now I can! Another angel to welcome to our family. Overwhelmed with excitement!"

    Kim is about 12 weeks pregnant.

    Kim Kardashian really has become Kanye West's muse. After rapping about his love, 31, on his tracks "Way Too Cold" and "Perfect Bitch," the Grammy-winner, 34, pays homage again in his just-leaked new song, "Clique" -- which seems to reference the infamous 2007 sex tape starring Kardashian and ex Ray J.

    As leaked on TMZ, "Clique," to be featured on West's new album "Cruel Summer," includes the line: "Eat breakfast at Gucci. My girl a superstar all from a home movie."

    Titled "Kim Kardashian: Superstar," the explicit home video starring Kardashian and Ray J (real name: William Ray Norwood), 31, helped Kim become a household name. She moved on to become a reality superstar and a bonafide mogul.

    "I've made mistakes in my life for sure," Kardashian stammered when asked about the tape by Barbara Walters last year.

    Said mom Kris Jenner: "It was devastating for the whole family. You cry yourself to sleep for a few nights, then you hire an attorney."

    Dating longtime pal West for nearly six months, Kardashian recently told New York Magazine, "I just really truly feel so much more calm now."

    Nicki Minaj raps: 'I'm a Republican voting for Mitt Romney' on mix tape

    Is Nicki Minaj voting for Mitt Romney? The rapper-singer, who is nearing a deal to become a judge on Fox's "American Idol," gives what appears to be an endorsement of the Republican presidential nominee on Lil Wayne's "Dedication 4," the recently released fourth installment in his mixtape series.

    During an instrumental on "Mercy," the fifth track on the album, Minaj raps: "I'm a Republican voting for Mitt Romney, you lazy bitches are [expletive] up the economy." (Listen to the track below.)

    RapDose, which first pointed out the lyrics, noted that her rap was performed over Kanye West-produced beats; West attended the 2008 Democratic National Convention in Denver in support of President Obama.

    Nicki Minaj berates, curses fans after U.K. concerts cancellation

    5 scandals Kanye should put to rest on his 35th birthday

    It's Kanye West's 35th birthday and we just didn't know what to get him. After all, what do you buy for the guy who just sold a pair of sneakers on Ebay for upwards of $90,000? You buy him nothing. Instead, Kanye, we treat you to this list of your five biggest missteps thus far in your career. It's our hope that as you round the corner into the latter half of your third decade, you can do so with less focus on scandal, and more focus on your music--which is pretty great.

    • Dating Kim Kardashian
      Tempting as it is to pretend this just isn't happening, it appears that Kanye and reality nuptial queen Kim Kardashian are romantically involved. Not that we don't wish them both happiness in their own right, but the track records here for attention-grabbing for the sake of attention-grabbing aren't great. Relationships that work aren't played out in front of cameras. (Do you really need the reminder, Kim?) And now they're already talking about getting married? Help us. Or at the very least, promise if you do get married, it will happen far, far away from any cameras.
    • Colossally awful tweets 
      Most Twitter accounts ought not to be taken too seriously, and Kanye's certainly falls into that category. It's served as a place for ranting against those who pair hoodies with sport coats,  and sometimes offers wise advice, like reminding his 7 million followers "no alcohol before tattoos." But it's also been the perfect place to put his outsized ego on display. "God chose me. He made a path for me. I am God’s vessel. But my greatest pain in life is that I will never be able to see myself perform live," he wrote in 2009. 
    • Abortion commentary
      If ever there was a subject not fit for discussion in 140-character increments, it's the abortion. But that didn't stop Kanye, who actually never said whether he supported it or not, but rather commented on the price of the procedure. His remarks were so outrageous, the fact that they were written on Twitter is almost beside the point. On this occasion, West never apologized. 
    • 'George Bush doesn't care about black people'
      He just said WHAT? West went off-script during a portion of the Hurricane Katrina telethon, offering up his opinion of how the then-president was treating African-Americans in the wake of the storm. Did it open up the dialogue about the treatment of Katrina victims? Certainly. Did it do so in a way that would be most productive? Doubtful. Instead of the storm being the message, Kanye was. In Bush's recent memoir, he wrote that the implication that he was racist was "the worst moment of my presidency."
    • And the No. 1 biggest misstep: 'I'ma let you finish'
      This stage-crash heard around the world barely warrants any additional explanation (but in case you just joined planet Earth and need a rehash of exactly how Kanye interrupted Taylor Swift's acceptance speech at the MTV Video Music Awards, go here). Despite several apologies (one, likening himself inexplicably to Ben Stiller in "Meet the Parents") this is likely going to follow West around the rest of his life. On the upside, this awful display of manners has given us many years worth of comedy. A Tumblr page devoted to "Kanyegate"? Yes, please.

    Kanye West gets 3 albums on Rolling Stone's revised 500 greatest list

    LONDON -- Three Kanye West albums have made it on to the latest edition of Rolling Stone magazine's authoritative "500 Greatest Albums of All Time" list, placing him among the greats of popular music.

    The new ranking, which combines a 2003 list (updated in 2005) with a later survey of the 2000s, saw two Radiohead records join the elite club, while long-established names including Bruce Springsteen and Bob Dylan also had albums added.

    Rolling Stone has published the list, along with details of the albums and several new recording histories based on first-hand accounts, in "bookazine" format available for $11.99 on newsstands between Friday and July 25 in the United States.

    As with any survey that tries to put arguably the greatest rock and roll recordings into a particular order, there was plenty of heated debate among the journalists and editors who came up with the final list.

    Much of the hard work had been done, however, with hundreds of reporters, executives and musicians involved in the earlier surveys.

    "We had arguments in the office, and I hope those arguments are replicated elsewhere," said Christian Hoard, a senior editor at Rolling Stone, of the selection process.

    "These special issues are great sellers," he told Reuters. "But they also turn people on to music they haven't heard, and hopefully start fun arguments too.

    "People like to get angry about these 'best' lists. It was really a great deal of fun to make."

    The big beneficiary was U.S. hip-hop star West, who saw 2005 album "Late Registration," "The College Dropout" (2004) and "My Beautiful Dark Twisted Fantasy" (2010) make it to the top 500.

    In total, 30 albums were added and 30 taken away, with the casualties including several artists well-represented on the list already and whose "lesser" albums have now been dropped.

    The highest entry among recent albums was West's "Late Registration" at No. 118.

    Asked whether the relatively low position of recently released albums reflected a barren period for great rock and pop, Hoard replied:

    "My personal opinion is no. Music is as inspirational as it's ever been.

    "Things get clearer as the years pass. If you held this poll in 10 years, say, Arcade Fire could be a lot higher and the same could be said of Kanye West. Reputation and time definitely help an album, especially with pollers like ours."

    Canadian band Arcade Fire's Funeral is among the 30 additions, as is British act Arctic Monkeys for their 2005 hit "Whatever People Say I Am, That's What I'm Not."

    Radiohead features twice -- for "Amnesiac" (2001) and "In Rainbows" (2007), Jay-Z is added for "The Black Album" (2003), Lil Wayne makes it with "Tha Carter III" (2008) and the late Amy Winehouse for "Back to Black."

    Among those dropping out to make way for the additions were The Beach Boys ("Sunflower"), David Bowie ("Changesone"), Elton John ("Elton John") and Madonna ("Music").

    The first change to the previous list comes at number 59, leaving the Beatles to dominate the top 10.

    The Fab Four feature no less than four times in the first 10; at number one ("Sgt. Pepper's Lonely Hearts Club Band"), three ("Revolver"), five ("Rubber Soul") and 10 ("The White Album").

    Three acts have 10 albums each on the list -- the Beatles, Rolling Stones and Bob Dylan -- and the oldest album on the list is from 1952 ("The Anthology of American Folk Music").

    Only 40 albums released since 2000 feature, compared with 187 from the 1970s.

    Kanye West changes song title from 'Theraflu' to 'Way Too Cold'

    Maybe "Theraflu" just had way too many bad symptoms associated with it.

    Kanye West has changed the title of his controversial new song following a backlash from the manufacturer of the drug it's named after, who slammed the rapper for inappropriately cribbing their product's name.

    Henceforth, West would like you to know that you should call the track "Way Too Cold."

    Sniff, sniff!

    So what's he saying about the switcheroo, and why'd he do it?

    West is chalking it up to a "creative decision."

    "I changed the name of the song THERAFLU to WAY TOO COLD and you can buy it now at KANYEWEST.COM," the rapper tweeted yesterday, providing a link to his official website, where he explains the reason.

    Doesn't look like anything else with the song has changed, though, including punchy lyrics like "I'll admit I fell in love with Kim around the same time she had fell in love with him," presumably name-checking rumored ladylove Kim Kardashian while trashing her ex, Kris Humphries. "Well, that's cool, baby girl, do you thing / Lucky I ain't have Jay drop him from the team." (Jay-Z is a co-owner of baller Humpries' team, the New Jersey Nets.)

    The song, which also includes the lyrics "Tell PETA my mink is draggin' on the floor," grabbed PETA's attention as well, and they promptly blasted the rapper by issuing a statement that read, "What's draggin' on the floor is Kanye's reputation as a man with no empathy for animals or human beings."

    Earlier this month, Theraflu manufacturer Novartis got up in arms over West's use of their product name, saying that "Novartis Consumer Health in no way endorses or approves of the references or use of the image and likeness of Theraflu in this manner."

    Hope they're feeling better now that he's made the switch!

    Kanye West's new single makes PETA and Theraflu sick

    Theraflu big wigs are giving Kanye West the cold shoulder over his new song, named after the cold and flu-calming brand.

    Shortly after releasing "Theraflu," the hip-hopper came under fire from Theraflu reps, who told E! News, "Novartis Consumer Health, the maker of Theraflu, is aware of a song recently released by rapper Kanye West, which contain references to Theraflu in its title, lyrics and artwork. Novartis Consumer Health in no way endorses or approves of the references or use of the image and likeness of Theraflu in this manner."

    And they aren't the only ones miffed by the single...

    PETA is also peeved about the song, due to this particular lyric from the loquacious rapper: "Tell PETA my mink is draggin' on the floor."

    "What's draggin' on the floor is Kanye's reputation as a man with no empathy for animals or human beings," PETA Senior Vice President Dan Mathews tells E! News in a statement. "He's a great musician but doesn't seem to have the fashion sense to design anything more than caveman costumes. We keep hoping that one day he'll find his heart and join evolved style icons--including Russell Simmons, Pink and Natalie Portman--who have dropped animal skins."
